How IRS Publication 550 Classifies Your GLD Gain

The current edition of IRS Publication 550 defines collectibles gain or loss as a “gain or loss from the sale or trade of a work of art, rug, antique, metal (such as gold, silver, and platinum bullion), gem, stamp, coin, or alcoholic beverage held more than 1 year.” Table 4-4 in the publication sets the maximum capital gains rate for collectibles at 28%.

The rule also covers fund shares that hold gold. Publication 550 says: “Collectibles gain includes gain from the sale of an interest in a partnership, S corporation, or trust due to unrealized appreciation of collectibles.” GLD is a trust that holds gold bullion. When your shares rise because gold rose, the IRS treats your gain as growth in the value of a collectible. The tax code says the same thing in 26 U.S.C. § 1(h)(5)(B).
